Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Spiks application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the App.

These Terms constitute a legally binding agreement between you and the operator of the Spiks application ("we", "us", "our").

2. Description of the App

Spiks is a mobile application for learning English. The App provides:

  • Interactive lessons and exercises
  • Pronunciation practice with speech recognition
  • Progress tracking and personalized learning paths
  • Premium features available via subscription

3. Account Registration

3.1 Eligibility

You must be at least 17 years old to use the App. By creating an account, you confirm that you meet this requirement.

3.2 Sign In

You may register using your existing Google or Apple account. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it.

3.3 Accurate Information

You agree to provide accurate and up-to-date information when registering and to update it as necessary.

3.4 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms.

4. Subscription and Payments

4.1 Free and Premium Access

Some features of the App are available for free. Full access requires a paid subscription.

4.2 Subscription Plans

Subscription options, pricing, and included features are displayed within the App and in the App Store / Google Play listing. Prices may vary by region.

4.3 Billing and Auto-Renewal

  • Subscriptions are billed in advance on a recurring basis (monthly or annual, depending on the plan selected)
  • Your subscription automatically renews at the end of each billing period unless cancelled at least 24 hours before the renewal date
  • Payment is charged to your Apple ID or Google account at confirmation of purchase and at the start of each renewal period

4.4 Cancellation

You may cancel your subscription at any time through:

  • iOS: Settings → Apple ID → Subscriptions → Spiks → Cancel
  • Android: Google Play → Menu → Subscriptions → Spiks → Cancel

Cancellation takes effect at the end of the current billing period. You retain access to premium features until that date.

4.5 Refunds

All payments are processed by Apple or Google. Refund requests are handled in accordance with their respective refund policies:

4.6 Free Trial

If a free trial is offered, it will be clearly stated in the App. Unused trial time is forfeited upon purchase of a subscription. Your subscription will automatically begin at the end of the trial period unless cancelled beforehand.

4.7 Price Changes

We may change subscription prices at any time. You will be notified of any price change before it takes effect. Continued use of the subscription after the change constitutes acceptance of the new price.

5. Acceptable Use

5.1 Permitted Use

You may use the App solely for personal, non-commercial purposes of learning English.

5.2 Prohibited Actions

You agree not to:

  • Copy, modify, distribute, sell, or sublicense any part of the App
  • Reverse engineer, decompile, or disassemble the App
  • Use automated tools (bots, scrapers) to access the App
  • Attempt to gain unauthorized access to any part of the App or its infrastructure
  • Use the App for any unlawful purpose
  • Impersonate another person or entity
  • Interfere with or disrupt the operation of the App

6. Intellectual Property

All content within the App — including but not limited to text, audio, graphics, user interface, and software — is the property of Spiks or its licensors and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

7. Microphone and Voice Data

The App uses your device microphone to record speech for pronunciation exercises. Audio is transmitted to OpenAI for speech-to-text processing and is not stored after processing. For full details, see our Privacy Policy.

By using pronunciation features, you explicitly consent to this use of your microphone.

8. Third-Party Services

The App integrates with third-party services including Google Sign In, Apple Sign In, OpenAI, and payment processors. Your use of these services is governed by their respective terms and privacy policies. We are not responsible for the practices of these third parties.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

  • The App will be uninterrupted or error-free
  • Any errors will be corrected
  • The App is free of viruses or harmful components
  • The results obtained from using the App will meet your expectations

10. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Spiks and its operators from any claims, damages, losses, and expenses (including legal fees) arising out of your violation of these Terms or your use of the App.

12. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if you breach these Terms. Upon termination, your right to use the App ceases immediately.

You may delete your account at any time from within the App settings. Account deletion results in permanent loss of your progress and data.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via the App or by email. Your continued use of the App after the updated Terms take effect constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of the Republic of Moldova. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of Moldova.

If you are an EU resident, you also have the right to bring disputes before the courts of your country of residence.
